Terms of Use

Upon successful payment, Haezerstudios grants you a non-exclusive, non-transferable licence to use the licensed track (“Music”) strictly in accordance with the usage type, territory and duration selected at the time of purchase (“Licence Parameters”). This licence covers both the master recording and the underlying composition.

Depending on the Licence Parameters you select, you may use the Music in:

• ·Commercial advertisements (TV, cinema, online)
• ·Social media content (YouTube, Instagram, TikTok, Facebook and similar platforms)
• ·Film, documentary and television productions
• ·Video game soundtracks and trailers
• ·Podcast intros, outros and background music
• ·Corporate presentations and internal communications
• ·Broadcast productions

The specific permitted uses are defined by the usage type selected at checkout and detailed in your licence agreement.

You may not:

• ·Resell, sublicense, transfer or share the Music or your licence with any third party
• ·Use the Music in any project not covered by your selected Licence Parameters without purchasing an additional licence
• ·Use the Music in pornographic, defamatory, hateful, violent or unlawful content
• ·Use the Music to train, fine-tune or develop any artificial intelligence or machine learning system
• ·Claim ownership or authorship of the Music
• ·Synchronise the Music in a way that exceeds the scope of your selected usage type, territory or duration
• ·Use the Music after your licence term has expired without renewing

Your licence is valid only within the territory and for the duration selected at checkout. Use outside the licensed territory or beyond the licence duration constitutes infringement and requires purchase of an additional licence.

All prices are displayed in USD. Payment is processed securely via PayPal. Your licence is granted only upon receipt of cleared payment. We do not offer refunds once a licence has been issued and the download link has been accessed, except where required by applicable law.

Upon successful payment you will receive:

• ·An email confirmation with your licence agreement attached
• ·A download link for the licensed audio file(s)

All Music on this Platform remains the exclusive property of Consular Recordings (Pty) Ltd T/A Haezerstudios or its respective rights holders. These Terms do not transfer any ownership rights to you. All rights not expressly granted are reserved.

You agree to indemnify and hold harmless Haezerstudios, its directors, employees and affiliates from any claims, damages, losses or expenses (including legal fees) arising from your use of the Music in breach of these Terms.

To the maximum extent permitted by law, Haezerstudios shall not be liable for any indirect, incidental, special or consequential damages arising from your use of the Platform or the Music. Our total liability to you shall not exceed the amount paid for the relevant licence.

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated date. Continued use of the Platform after changes constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts of South Africa.
